As
many as 10,256 cases are pending for forensic analysis in various
Regional Forensic Science Laboratories at Nagpur, Amravati, Pune,
Aurangabad, and Nashik and Forensic Science Laboratory in Mumbai. Of
these, as many as 1,869 are pending with Regional Forensic Science
Laboratories at Nagpur and Amravati.
Forensic laboratories are
helpful for investigating machinery in cases requiring DNA test,
physical examination of evidence, viscera analysis, psychological
examination, and cases involving ballistics and cyber issues. Besides,
the cops also require help from forensic laboratories in cases of Trauma
and Self Injury (TASI). However, owing to a variety of reasons
including vacancies, number of cases were pending with these
laboratories.
Earlier this month, Bombay High Court had expressed
concern over pendency of thousands of cases with forensic laboratories
and had stated that it affected the criminal justice system. The court
also directed the State Government to fill up vacancies, consider
setting-up of ‘mini-forensic laboratories’ in every district and tehsil,
and take a policy decision within three months in this regard to reduce
pendency. Following the court comments, Home Department has reviewed
pendency of cases with the laboratories.
State Home Department data
reveals that between January 2013 and July 2014, Directorate of Forensic
Science Laboratories disposed of 2,71,323 cases that had come for
analysis. The chemical analysis reports in these cases have been sent to
the respective police/medical officers. However, at the end of July
2014, still 10,256 cases were pending with various laboratories.
While
coming up with the number of pending cases, the Home Department has
also asked all the Commissioners of Police (CP) and Superintendents of
Police (SP) in the State to take stock of cases shown as pending with
laboratories. Home Department has released data based on the inputs
given by Directorate of Forensic Science Laboratories, and has asked the
CPs and SPs to tally the data available with them in this regard. In
case of discrepancy between the data with them and that with the
Directorate, the said officers have been asked to contact respective
laboratory and seek duplicate copy of analysis report.
At the same
time, Home Department has pointed out that Medical Officers did not
mention the cause of death in post-mortem reports and just write
‘viscera preserved, opinion reserved’. In such cases, CPs and SPs have
been advised to obtain necessary certificate from respective forensic
science laboratory, and confirm cause of death from respective Medical
Officer, so that further action could be initiated.
As far as
pendency is concerned, a total of 2,086 cases are pending with Forensic
Science Laboratory, Mumbai. These include maximum 1,252 related to
prohibition cases, followed by 300 each pertaining to toxicology and
biology, and 234 related to general analysis. Besides, the laboratory
has pendency of 3,769 cases received from various police divisions
across the State. These include the highest 1,417 related to TASI; 1,081
of DNA test; 1,014 of cyber analysis; 198 of ballistics examination, 55
of physical examination, and four related to psychological analysis.
Among
Regional Forensic Science Laboratories, the highest 1,305 are pending
with Aurangabad laboratory, followed by 1,242 with Nagpur, 1,060 with
Pune, 627 with Amravati, and 167 with Nashik laboratory. Of the total
cases pending with Nagpur laboratory, maximum 718 cases are related to
prohibition, 278 to biology, 122 to toxicology, 104 to DNA test, 11 to
ballistics, and nine of general analysis.
